Be it known that the Owosso Charter Township Board of Trustees met in regular session on Monday May 10, 2010 at 7:00 P.M. in the Township Board Room, located at 2998 W. M 21, Owosso, Michigan 48867.

Call to Order: Supervisor Miller led the Pledge to the Flag.

Public Comments: Opened at 7:07 pm and closed at 7:15 pm.

Steve Pratt candidate for Mr. Owosso inquired about the status of holding a mud bog event on the Matt Siminski property located on S. Delaney Rd. Mr. Pratt was informed a mud bog event on Mr. Siminski’s property would be in violation of the zoning ordinance. Mr. Pratt will try to encourage Mr. Siminski to come before the township zoning and planning commission to obtain a conditional use permit so that Mr. Siminski could legally hold mud bog events on his property in the future.

Mike Thornton states Mr. Siminski was not above the zoning law.

Chrest Marine: Joe Curran, president of Chrest Marine LLC announced that Chrest purchased the assets of Maurell Products on April 13, 2010 and they currently employ 42. The company plans to invest $1,300,000.00 of which approximately $350,000.00 will be used for building rehabilitation purposes and the remaining will be invested in personal property over the next several years. Chrest Marine LLC is seeking tax incentives for their investment, though the township would need to classify the property as an Industrial District first. Moved Trustee Schultz, Second Trustee Krajcovic to authorize the board to move forward to create an Industrial District and to publish a public hearing notice. Sheriff’s Dept. Rep./County/State Rep. Comments: SCSD Report attached to minutes. The SCSD responded to one hundred and forty one (141) incidents in Township during the month of April 2010.

Commissioner Henrietta Sparkes: County Commissioners are working on the Clinton/Ionia/Shiawassee Rails to Trails. The name of the committee is Mid West Mi Trail Committee. The trail is 41miles long and 100 ft wide. The trail will be self-insured. Therefore Owosso Charter Township will not be liable should anything happen on the trail.

There is a correction officer opening at the Sheriff Department. The last time the county advertised a vacant position 150 people responded to the ad.

Linda Cordier will address mud bogging at a special meeting to be held on May 26th at 7:00 pm at the Surbeck Building in Corunna.

Cemetery Report: Report on file. Two (2) open/close reported for the month of April 2010, for a total income of $1,300.

Assessor Report – Board of Review: Report on file.

Fire Report: Report on file. The department responded to thirteen (13) calls during the month of April 2010.

Moved Trustee Schultz, Second Treasurer Cudney to authorize the installation of a dry fire hydrant on property owned by Mike Constine, tax roll #006-28-100-004 located on S. Ruess Rd. at a cost not to exceed $1,000.00 from the fire fund. Roll Call: Treasurer Cudney-Yes, Trustee Campbell-Yes, Trustee Schultz-Yes, Trustee Archer-Yes, Trustee Krajcovic-Yes, Supervisor Miller-Yes, Clerk Gute-Yes.

Gute asked that the department continue to search for other locations to install additional dry hydrants within the fire service district.

Fire Report (cont.): The firemen raised $1,600.00 hosting a spaghetti dinner fundraiser. They plan use the money to purchase dress uniforms for the firemen. According to Jim Demis, CPA, the board needs to create a fundraiser line item in the fire budget. Moved Treasurer Cudney, Second Trustee Schultz to add the fundraiser line item to the fire fund budget. Ambulance Report: Manager MacDonald was not able to attend the meeting tonight.

Building Inspector/Code Enforcer: Report on file. Permits issued – 1 Building, 1 Plumbing, 1 Mechanical and 4 Other (2 Pool, 1 Sign & 1 Code Book) for a total of $717.00 collected for the month of April 2010. Another complaint was received regarding junk stored on the Simpson Rd property.

Unfinished Business:

a) Unfinished Business: a) Doug Piggott – Rowe Engineering – Zoning: Attorney Bowne continues to draft language compatible to the new zoning map and will soon publish the public hearing notices. He will provide the board with the proposed language changes prior to the next meeting.

b) Bob Ardelean: Moved Trustee Krajcovic, Second Trustee Archer to sell approximately 3 acres more or less of township owned property in the industrial park known as tax roll #006-23-300-001 to L. Robert and Arlene Ardelean in the amount of $3,000; the township owned detention pond will not be included in the sale and the township will retain an ingress egress easement to and around the detention pond; the Ardelean’s will be responsible for the cost of the survey and Attorney Bowne will draw up the agreement. c) Cemetery: The dead oak tree in Section 1 south side will be cut down and if necessary the tree that was struck by lightning will also be removed.

New Business:

a) Crest Marine: Addressed under Public Comments 6A on agenda.

b) Keith Maike: Treasurer Cudney, Second Trustee Schultz to authorize Wolverine Fireworks to conduct a fireworks display at approximately 10:30 p.m., on June 5, 2010 at 1421 N. Delaney Road providing Wolverine submit the appropriate liability insurance bond(s) reflecting Owosso Charter Township as an additional insured, State of Michigan permit(s) and a site plan and to allow the fire department to standby at this location during the event and; the homeowner will reimburse the department for all costs associated. Roll Call: Trustee Archer-Yes, Treasurer Cudney-Yes, Trustee Krajcovic-Yes, Trustee Schultz-Yes, Trustee Campbell-Yes, Clerk Gute-Yes, Supervisor Miller-Yes.

c) Magnet: Consensus of the board was not to contribute financial support to Magnet this year.

d) SATA: Trustee Schultz: There is a need for a road millage before a SATA millage. Clerk Gute: Concern in regards to creating economic development on tax dollars. When houses are built and added to the tax roll the millage rate is never reduced. Stoney Creek said they were going to provide transportation for their residents and they have not done that. Certain developments in the areas that most want SATA pay little or no taxes and if the millage passes the financial burden is placed on the homeowners. Seniors are eligible for free and reduced bus passes through the council on aging. Need to create assessment districts. SATA does contract separately with people. Board Consensus: Not to place a millage on the ballot. Supervisor Miller: Does not think SATA was looking for a millage but instead wanted the township general fund to pay for it.

e) Library: Township library representative Barb Greve’s term on the library board expires in June. The position is term limited so she is not able to continue as the township representative. Board members will seek a replacement and if not an ad will be placed in the paper.

Payment of Bills: Moved Trustee Krajcovic, Second Treasurer Cudney to approve the April 12, 2010 checklist for the payment of bills. Roll Call: Clerk Gute-Yes, Treasurer Cudney-Yes, Trustee Schultz-Yes, Trustee Archer-Yes, Trustee Krajcovic-Yes, Supervisor Miller-Yes, Trustee Campbell-Yes. Cemetery checks – 994 – 999, Fire checks 3624 – 3652, General Fund checks 4456 – 4480, Sewer checks 368– 369, T & A checks 2024 – 2027 and Water checks 570 – 574 shall be released for payment.

Public Comments: Opened @ 9:14 pm. Closed @ 9:17 pm.

Resident Mike Thornton would like to see the board adopt a moratorium policy regarding millage requests. The policy would state that if a millage request fails it would not be placed on the ballot again for X number of years.

Board Reports and Comments: A letter was received from the Census Bureau. Canvassers are going door to door now. The Census letter and a picture of all the credentials the canvassers will be carrying will be posted in the outdoor bulletin board.

Where does the township stand on the water agreement? Committee has not heard back from the city.

Building committee will look into what work is necessary for the maintenance and repair of the township parking lot and will bring the information to the next township board meeting.

Commissioner Henrietta Sparkes: County Commissioner update. Commissioners will place a .25 millage request on the ballot for the senior citizens (an increase to purchase the senior citizen complex in Morrice). Ms. Sparkes hopes to finish out her term, though will not seek a new term this year.

Cemetery Report: Report on file. No income reported for the month of March 2010.

Assessor Report – Board of Review: Report on file.

Fire Report: Report on file. The department responded to 25 calls during the month of March 2010.

Moved Trustee Schultz, Second Clerk Gute to authorize the purchase of 6 radio’s at a cost of $2,793.00. Roll Call: Trustee Campbell-Yes, Trustee Schultz-Yes, Trustee Archer-Yes, Trustee Krajcovic-Yes, Supervisor Miller-Yes, Clerk Gute-Yes.

Ambulance Report: Report on file. MMR responded to a total of 51 medical calls for the month of February 2010.

Building Inspector/Code Enforcer: Report on file. Permits issued – 3 Building, 2 Electrical, 2 Plumbing, 3 Mechanical and 3 Other for a total of $1,740.00 collected for the month of March 2010.

A mud bog event took place again at the Siminski residence on April 10th. Administer Delaney will address possible violations at 2293 and 2740 Krouse Rd. and 659 Hollywood Dr.

b) Weed Bid: Moved Trustee Krajcovic, Second Trustee Archer to hire Richard Gute as the Weed Commissioner for the summer 2010 mowing season at $49.00 per hour and $49.00 per minimum. c) Osaukie Rd: Home and yard in deplorable condition. Health Department and Administrator Delaney working at trying to get it cleaned up. A person is interested in purchasing it and cleaning it up.

d) Road Projects: Moved Trustee Schultz, Second Trustee Krajcovic to approve the 2010 road projects as submitted by the road commission. Discussion: Clerk Gute explained that the township normally spent $150,000 per year on roads and would receive an additional $40,000 to $80,000 in gas tax monies but we no longer receive the gas tax. In 2008 we did a lot of roads because we wanted to get the subdivisions done. She also had concern with the delinquent taxes that may have to be paid back in 2011 (per Attorney Fahey) and we have not heard if the township might have to pay anything back. Gute would rather see the board pare back road projects this year. 2010 Road Projects: Asphalt Chipman from Cronk to .30 miles south of Wilkinson Rd. Sealcoat Delaney Rd from Ruess Rd. to Mason Rd. Gravel Wade Rd. from Wilkinson Rd. to Mason Rd. Dewey Rd from Ruess Rd. to Smith Rd. Mineral Well Brine all gravel roads, two wide continuous application.

New Business:

a) Bob Ardelean: Mr. Ardelean submitted an offer to purchase township owned property in the industrial park known as parcel A. He has offered the township $3,000 less any and all property for the township owned retention pond. His plans are to use the property to crush concrete. Miller would like to vote on this tonight. Gute stated this is industrial property and the township sold the Viron (Baker) property for $20,000. She questioned if cement dust would enter factory venting-systems. Resident Richard Gute felt the board should take under consideration the problems they had with crushing on Cleveland Ave and that there are neighbors close to this property as well. Resident Opal Chase agreed and stated the property would be right outside her bedroom window. She claims she can’t have her bedroom window open now because of American Recycling and the property Mr. Ardelean is interested in would be even closer to her property than American Recycling is now. Board members were interested in walking the property, reviewing the deed and etc. Consensus of the board was to place the item on the May agenda.

b) Brownfield Development: Moved Diane Krajcovic, Second Trustee Schultz to authorize and direct Trustee Krajcovic to pay off the Mi DEQ Brownfield loan in the amount of $32,465.24 and to pay approximately $22,000 towards the township Brownfield loan. Board Reports and Comments: Trustee Archer: Submitted a WWTP report and stated she received a call regarding brush cutting by road commission on King Rd.

Trustee Schultz: Submitted the Utility Authority Audit and monthly report.

Clerk Gute: Had announced a month or two ago that she was going to have representatives from the differing insurance companies speak with board and employees sometime in April or May. However, Chief Johnson and Supervisor Miller had already met with one of them and Melissa attended last month. She wanted to know if the board still wanted her to set up this insurance meeting for the board and employees. Consensus of the board was that it was not necessary.

Since there was not an annual meeting this year the board did not receive yearend reports from the differing departments and asked if the board still wanted them. In the past reports have always been by calendar year and she would like to see the reports reflect the fiscal year that the township is on (April 1 through March 31st).

Has concern with hall security and the important records in the township offices. Todd Blevins found the side door open about 11 pm after the last meeting. The door between the fire department and hall is unlocked and the fire department could accidentally leave a door open when they go to a fire. Once her office door was open. Just recently Dick Gute was checking trucks and the bay door would not go down.

Miller: Will discuss hall security at the next board meeting.

Gute: The firemen had requested coordinating insurance benefits. Melissa Swims sent a bill to coordinate those benefits from February through the July renewal date. It will cost $1,386.10 to coordinate them now. The check has been cut and is on tonight’s checklist. Does the board want to pay to coordinate these benefits now or wait until the July renewal?

Chief Johnson: Asked to have the benefits coordinated now.

Moved Trustee Krajcovic, Second Trustee Schultz to authorize the payment of check number 3619 to Western Insurance Co. in the amount of $1,356.10 to coordinate benefits effective February through the July 2010 renewal.
