Be it known that the Owosso Charter Township Board of Trustees met in regular session on Monday August 09, 2010 at 7:00 P.M. in the Township Board Room, located at 2998 W. M 21, Owosso, Michigan 48867.
Call to Order: Supervisor Miller led the Pledge to the Flag.

Jeff Sines inquired about a letter sent to his neighbor regarding a zoning issue and asked if he could have a copy of it.

6b) Wausaukee Composites: Wausaukee received a contract from Caterpillar and plan to install a new paint line to fulfill the contract obligation. They currently employ 132 and by adding the paint line they hope to add an additional 98 employees. Wausaukee is planning to invest over 1.9 million and would like the township to consider them for an IFT. Moved Trustee Schultz, Second Trustee Campbell to set up an IFT public hearing for September 13, 2010 and to publish it in the newspaper. Ayes: All. Nayes: None.
Sheriff’s Dept. Rep./County/State Rep. Commens: SCSD Report attached to minutes. The SCSD responded to one hundred and Eighty Nine (189) incidents in Township during the month of July 2010.
Cemetery Report: Report on file. One (1) open/close burial, (1) Foundation and Three (3) lots sold reported for the month of July 2010, for a total income of $2,525.00
Assessor Report: Report on file.
Fire Report: Report on file. The department responded to thirteen (13) alarms during the month of July 2010.
Moved Trustee Schultz, Second Trustee Archer to authorize the firemen to take fire trucks to the fair, parades, funerals, schools, senior centers and etc. within shiawassee county. Ayes: All. Nayes: None.
Ambulance Report: Report on file. MMR responded to fifty-seven (57) medical calls for the month of July 2010.

Unfinished Business:
Township Hall Parking Lot Resurfacing: Trustee Schultz chose to hire Arrow Construction to sealcoat and repair Fire Station 1 and 2 parking lots. Arrow stated they would do the work for the same price Advance had quoted. Clerk Gute states the parking lot at the MMR building needed to be seal coated and repaired as well and it could be done at the same time. Though MMR signed a contract to take care of the building and grounds she did not feel MMR should have to pay for the entire parking lot since they don’t really use it. I suppose MMR could return it to gravel if they chose said Gute. MMR has been good to the township in that they have allowed us to use the building and parking lot free of charge for elections. She spoke with manager MacDonald about it and MacDonald told her they would pay for half. Trustee Schultz felt half was too much for MMR to pay. He did not feel MMR should pay anything since they did not use the parking lot. The cost to do this is $1,598. Moved Trustee Archer, Second Treasurer Cudney to authorize the sealcoat and repair work to be done to the MMR parking lot and that the township will pay 2/3’s of the cost and charge MMR 1/3. (MMR $532.67 – Township $1,065.33). Roll Call: Trustee Campbell-Yes, Supervisor Miller-Yes, Clerk Gute-Yes, Trustee Schultz-Yes, Treasurer Cudney-Yes, Trustee Archer-Yes.
Moved Clerk Gute, Second Trustee Schultz to authorize the clerk to cut a deposit check in the amount of $750.00 to Arrow Construction so that the sealcoat and repairs can be done to the MMR parking lot at the same time as the others. Roll Call: Trustee Campbell-Yes, Supervisor Miller-Yes, Clerk Gute-Yes, Trustee Schultz-Yes, Treasurer Cudney-Yes, Trustee Archer-Yes.
b) Cemetery Maintenance Job Description: Supervisor Miller announced that Trustee Schultz and himself had been looking at putting a new job description out for the cemetery maintenance employee and that all board members received another newly drafted description in their mailbox. He states that he still wants to tweak it and part of the tweaking would be that he wants to cut the maintenance pay through the winter months and instead pay the maintenance person $100 per burial but if the sexton did the burial he/she would receive $50.00.
Miller states he felt the maintenance person should do simple oil changes, etc. on the mowers. He asks the board to review what he presented then he will tweak it again for the next meeting.
Trustee Archer questioned the yearly salary in that if the board were to cut the pay would the board be paying enough money to the maintenance person during the busy months and asked if Mr. Blevins did the cemetery snowplowing. Miller felt it would be more than appropriate pay because there were only 11 burials for 2009 and that Constine plowed the cemetery. (clerk’s note: R&M Snow Removal plows the cemetery)

Clerk Gute clarifies adding the additional duties and the cut in pay. Gute felt Miller was picking on Mr. Blevins and that it would be totally wrong for the board to do this since Mr. Blevins signed a job description two (2) years ago that the board agreed upon and Mr. Blevins has already done a lot of extra things for us. She states Mr. Blevins moved the road over for us, etc. and felt Supervisor Miller was picking on Mr. Blevins. She feels Supervisor Miller doesn’t understand the amount of work involved at the cemetery and asks Miller why he would want to do this now.
Gute states this has gone on long enough and …Motion Clerk Gute, Second Trustee Campbell to throw out the new job description and; that Mr. Blevins remains under the job description he already signed and; to change the job description when Mr. Blevins leaves and; if the board wants him to do additional duties the board can ask him.
Discussion: Supervisor Miller felt a motion was not in order at this time and would like to tweak it and bring it back. Gute states she has a motion on the floor.
Miller questions Attorney Bowne regarding the legality of the motion. Bowne states a motion has been made and seconded so the board is going to have to act on it.
Trustee Campbell questions Supervisor Miller in regard to his looking into the future by saying nobody is going to die this month or that month. You don’t know what is going to come up. He has a description and he does it she said. I have been going through the cemetery ever since everyone has said how bad it looks and it always looks good to me said Campbell. She doesn’t understand where Miller is coming from and asks that he help her understand why he needs to change the description on his own right now. Miller states he is not changing the description.
Where is the committee in this asked Campbell? Miller states, Trustee Schultz and himself were the committee. Gute states a cemetery committee was never voted on. Miller said a committee had been appointed. Gute states Trustee Schultz and Supervisor Miller formed a committee regarding the tree removal but that the board never voted on a cemetery committee.
Miller states, I am not going after this right now, I said I would like to tweak this. He is under the impression that he would be paid the same this year and the new description would change in the year 2011 and if you read through the current job description all I did was clean it up said Miller. I took out where the Supervisor will blow out the lines.
Gute states it sounds like Supervisor Miller is on a power trip in that he does not want the maintenance person to have any contact with the clerk only the supervisor. Yes, I do want the supervisor said Miller. Since when did you become his boss when the entire board is his boss asked Gute!

Miller states he wanted to tweak it because he didn’t want anyone else to ride the mowers. That has happened with every maintenance person we’ve had said Gute. Miller states that shouldn’t happen! Gute states Bonnie Delaney helps Bob Delaney.
Miller states he believes it is time to reorganize and he believes it is time to clean it up. I am not going to have a cemetery maintenance person call me up and say it’s time for you to blow the lines out, if you want the job you blow the lines said Miller.
He can’t help it that his job description requires him to do that. He doesn’t know you don’t want him to call you said Gute. Just ask him to do it. You’re nitpicking just like you did with OTR said Gute.

If he wants to quit he can quit he has that prerogative said Miller.

Trustee Schultz states he remembers a prior board discussing the pay some time ago and because the maintenance person does more in the summer than in the winter the board left it as is. He felt the board should leave it as it is now.
Miller states part of his tweak is that he wants Mr. Blevins to keep a log of his time and a log on the mower. All over this world we see things changing and people taking less wages and I still need to tweak this some said Miller.
Trustee Campbell states Supervisor Miller you keep saying I want him to do this, I want him to do this and this is a board decision. It’s not just your decision you can’t just say I want him to do this. Why do you do that asked Campbell?

Gute doesn’t believe Mr. Blevins would sign a new description that would add more work for less pay and asked Supervisor Miller “as a school teacher for Owosso High how many times did you take a pay cut”. (no response)
Miller agrees with Cudney and states he believes that the board should say to themselves they should update certain policies throughout the time. Therefore I would encourage the board to vote no on this. I have already said this is not for tonight to pass. It is for tweaking, to have you read it and we will go from there said Miller.

c) Cost Recovery Ordinance Involving Consumers Power: Cost recovery charges for out of the ordinary standbys, etc. incidents would be charged to persons or entities that do not contract with or pay taxes to Owosso Charter Township Fire Department. Businesses would be charged if the department has to standby and wait for the business employee to show up (example Consumers Energy). Moved Treasurer Cudney, Second Trustee Schultz to adopt Owosso Charter Township Fire Charges Ordinance No. 8-9-10 in its final form and to publish the ordinance in the newspaper to become effective on September 13, 2010. Roll Call: Trustee Campbell-Yes, Supervisor Miller-Yes, Clerk Gute-Yes, Trustee Schultz-Yes, Treasurer Cudney-Yes, Trustee Archer-Yes.
New Business:
a) Demis & Wenzlick Audit Report: Moved and addressed under Public Comments item 6a).

c) Planning Commission Resignation: Z/P Commissioner Kioski will be resigning from the planning commission though Supervisor Miller has not yet received his resignation. Miller states Chad White is interested.
d) Attorney Fees: Clerk Gute asked that Attorney Bowne break his billings down according to departments so that the charges are paid from the appropriate fund. She also noticed the Attorney bill states the Supervisor met with the attorney to tweak the water contract and asked if the entire committee met regarding this. Supervisor Miller stated Trustees Schultz and Krajcovic were not available to meet at that time but he told the committee he wanted to meet with Attorney Bowne to establish some ideas. Gute stated the billing said that you met with him to tweak the contract and she felt the entire board should be involved with tweaking contracts or the township is going to keep on paying and paying attorney fees. Trustee Campbell felt Supervisor Miller again took it upon himself to meet without the committee and with water being an important issue the Supervisor should have set a time when the entire committee could attend. Miller felt he made the correct decision in that he could disseminate the information to the committee.

c) Planning Commission Resignation: Z/P Commissioner Kioski will be resigning from the planning commission though Supervisor Miller has not yet received his resignation. Miller states Chad White is interested.
d) Attorney Fees: Clerk Gute asked that Attorney Bowne break his billings down according to departments so that the charges are paid from the appropriate fund. She also noticed the Attorney bill states the Supervisor met with the attorney to tweak the water contract and asked if the entire committee met regarding this. Supervisor Miller stated Trustees Schultz and Krajcovic were not available to meet at that time but he told the committee he wanted to meet with Attorney Bowne to establish some ideas. Gute stated the billing said that you met with him to tweak the contract and she felt the entire board should be involved with tweaking contracts or the township is going to keep on paying and paying attorney fees. Trustee Campbell felt Supervisor Miller again took it upon himself to meet without the committee and with water being an important issue the Supervisor should have set a time when the entire committee could attend. Miller felt he made the correct decision in that he could disseminate the information to the committee.

Campbell asked Supervisor Miller to share with the board what they did.
Attorney Bowne stated that Gary Burk finally took the township revisions and came back with more revisions. Now the committee has got to get together again but as the Supervisor stated July was just too hectic for the committee to get together.
Payment of Bills: Moved Trustee Schultz, Second Trustee Campbell to approve the August 09, 2010 checklist for the payment of bills. Resident Lee Wing was glad to hear the audit was good and he would like to see the township adopt an ordinance limiting the number of garage sales one person could have.
