Be it known that the Owosso Charter Township Board of Trustees met in regular session on Thursday February 03, 2011 at 6:04 P.M. in the Township Board Room, located at 2998 W. M 21, Owosso, Michigan 48867.
Call to Order: Supervisor Miller led the Pledge to the Flag.
Members in attendance: Roll Call: Supervisor Miller-Yes, Trustee Schultz-Yes, Clerk Gute-Yes, Trustee Archer- Yes, Treasurer Cudney-Yes, Trustee Krajcovic-Yes. Absent: Trustee Campbell-Yes.
Others Present: Attorney Lynn Bowne and Fire Chief David Johnson.
Agenda: Moved Trustee Schultz, Second Trustee Krajcovic to accept the agenda as printed. Approved by Unanimous consent.
Special Business: A.) FOIA Lawsuit Resolution: Chair entertains Motion to retire into closed session at 6:06pm. So Moved by Trustee Schultz, Second Treasurer Cudney. Roll Call: Supervisor Miller-Yes, Trustee Schultz-Yes, Clerk Gute-Yes, Trustee Archer- Yes, Treasurer Cudney-Yes, Trustee Krajcovic-Yes. Absent: Trustee Campbell-Yes.
Clerks Note: The purpose of this Closed Executive Session is to discuss the Ardelean/Owosso Redi Mix FOIA Lawsuit Resolution.
Chair Motion to return to regular session at 6:30pm. Trustee Schultz makes that motion, Second Trustee Krajcovic. Approved by Unanimous Consent.
Moved Trustee Shultz, Second Treasurer Cudney to authorize the settlement of the Robert and Arlene Ardelean/Owosso Redi Mix/Imarino FOIA Abr. Alternative Dispute Resolution #78-09-009177 CZ-L in the amount of $1,500. Discussion: Clerk feels its wrong. Schultz agrees. Miller states the board does dispute the resolution because they feel they were in timely compliance. Roll Call: Supervisor Miller-Yes, Trustee Schultz-Yes, Clerk Gute-Yes, Trustee Archer- Yes, Treasurer Cudney-Yes, Trustee Krajcovic-Yes. Absent: Trustee Campbell-Yes.
B.) 2011-12 Budget Workshop: Preset budgets were not presented. Board sets all budgets. The budget hearing is attentively scheduled for February 14, 2011, though due to time constraints and fulfilling the necessary public notice requirements will ultimately determine when the hearing will take place.
